1 Cláusulas

Estos términos de la licencia (“Términos”) cubren todas las soluciones, servicios basados en software y aplicaciones web de WithSecure Corporation y cualquier entidad que controle a, sea controlada por, o comparta control común con WithSecure Corporation (en conjunto, “WithSecure”) con licencia o disponibles para usted y la organización que usted representa (en conjunto “usted”), incluidas las herramientas de soporte, los portales web, el firmware, el hardware y los servicios que soportan el uso en forma directa, la documentación relacionada y las actualizaciones y mejoras para cualquiera de los antes mencionados (en conjunto, la "Solución"). Si posee un acuerdo directo con WithSecure para el aprovisionamiento de la Solución, los términos y condiciones de dicho acuerdo prevalecerán sobre estos Términos. En caso de que existan discrepancias entre las distintas versiones de idiomas de estos Términos, la versión en idioma inglés prevalecerá.

IMPORTANTE – Antes de instalar o usar la Solución, lea con atención estos Términos. Si opta por aceptar, o instalar, copiar o usar la Solución, usted acepta estos Términos y se adhiere a ellos en nombre de su organización, y acepta haber leído, comprendido y acordado estos Términos y estar legalmente vinculado a ellos. Si no acepta todos estos Términos, no instale, copie ni use la Solución.

2 Licencia

Sujeto a estos Términos y al pago de las tarifas correspondientes de licencias y suscripciones, WithSecure le otorga el derecho no exclusivo, no transferible, no asignable y revocable de usar la Solución especificada, durante un período de tiempo determinado, según lo acordado por separado entre usted y WithSecure o sus revendedores o distribuidores. WithSecure y sus licenciantes se reservan todos los derechos no expresamente otorgados a usted.

En forma adicional, según su solicitud y la aprobación de WithSecure, WithSecure puede otorgarle el derecho limitado, no exclusivo y no transferible de evaluar la Solución por motivos no comerciales. Debe comprar una licencia/suscripción para la Solución para continuar usándola en forma comercial una vez que finalice el período de evaluación.

Usted puede:

  • instalar y usar la Solución solo en las unidades y dispositivos para los cuales tiene licencia para la Solución.
  • crear copias de la Solución por motivos de instalación y copia de respaldo únicamente y
  • ampliar la cantidad de licencias comprando más de ellas.

3 Limitaciones de la licencia

Usted no puede:

  • acceder, usar, copiar, explotar, divulgar o distribuir la Solución, a excepción de lo expresamente establecido en estos Términos;
  • demostrar, vender, ofrecer para la venta, distribuir o transferir la Solución o cualquier parte de ella a ningún tercero;
  • crear trabajos derivados basados en la Solución o en cualquier parte de esta;
  • decompilar, aplicar ingeniería inversa, desarmar o intentar derivar, obtener o modificar el código fuente de la Solución o cualquier parte de ella;
  • sublicenciar cualquiera de los derechos otorgados a usted en estos Términos;
  • usar la Solución o alguna parte de ella para implementar algún producto o servicio a fin de operarlo en la Solución o en conexión con ella para cualquier otro fin para el que la Solución fue provista;
  • bajo ninguna circunstancia, usar la Solución para los siguientes fines: (i) recopilar o distribuir información privada, contenido con derechos de autor o secretos comerciales para los que no posee derechos de recopilación o distribución; (ii) distribuir contenido ilegal, difamatorio, pornográfico, abusivo, acosador, amenazante o que posea contenido o código con funciones destructivas; (iii) acceder o distribuir pornografía infantil o zoofilia; (iv) enviar contenido no deseado; (v) malware, botnets, phishing, ataques de denegación de servicio, piratería ilegal, análisis de puertos no autorizado o acceso no autorizado; (vi) hacerse pasar por otra persona; (vii) infringir los derechos legales de otra persona; (viii) infringir las leyes aplicables; (ix) otros motivos invasivos o fraudulentos, o usos que puedan interferir con el funcionamiento de la Solución o la capacidad de otros usuarios de usar la Solución, o (x) gestionar cualquier contenido que esté en contra de las pautas de contenido permitido mantenidas por los terceros a quienes compró la Solución.

     

    Puede permitir que un tercero administre la Solución o la use para llevar a cabo servicios de seguridad para su empresa solo si el uso o la administración de dicho tercero es para su exclusivo beneficio o a su nombre, o usted es legalmente responsable por el uso de la Solución de parte de dicho tercero. No se permite ningún otro acceso a terceros para usar, copiar, divulgar o distribuir la Solución. Usted acepta aplicar los esfuerzos comercialmente razonables para garantizar que las partes no autorizadas no tengan acceso ni usen la Solución, y para que ni usted ni otro tercero realicen la copia, divulgación o distribución no autorizadas de la Solución, en forma parcial o total. Usted acepta notificar a WithSecure en forma oportuna sobre cualquier acceso, uso, copia, divulgación o distribución no autorizados de la Solución.

4 Propiedad intelectual

WithSecure y sus licenciantes conservan todo derecho, título e interés sobre las Soluciones y todas las herramientas provistas por WithSecure. A excepción de los expresamente establecido en la sección 2 (“Licencia”), ninguna parte de estos Términos debe considerarse como otorgamiento de ninguna licencia expresa o implícita, opción a licencia u otro derecho a ninguna información confidencial, tecnología software o derecho de propiedad intelectual incorporados en la Solución. Usted reconoce que WithSecure puede usar libremente cualquier sugerencia, comentario u otra opinión sobre la Solución.

5 Garantía

CONFORME A LO MÁXIMO PERMITIDO POR LA LEY, WITHSECURE Y SUS FILIALES, PROVEEDORES, REVENDEDORES Y DISTRIBUIDORES NO ESTABLECEN GARANTÍAS, EXPRESAS O IMPLÍCITAS, SOBRE LA SOLUCIÓN. LA SOLUCIÓN SE PROPORCIONA “TAL COMO ESTÁ”. WITHSECURE NO GARANTIZA LA EXHAUSTIVIDAD O PRECISIÓN DE LOS RESULTADOS O QUE LA SOLUCIÓN ENCONTRARÁ TODAS LAS VULNERABILIDADES NI DETECTARÁ TODO EL MALWARE U OTRO SOFTWARE DAÑINO. WITHSECURE TAMBIÉN RENUNCIA A CUALQUIER GARANTÍA DE COMERCIABILIDAD, ADAPTACIÓN PARA UN FIN EN PARTICULAR Y NO VIOLACIÓN.

CUANDO LA SOLUCIÓN INTERACTÚE CON LOS SERVICIOS DE CUALQUIER TERCERO O CUANDO SE UTILICEN SISTEMAS DE INFORMACIÓN O COMPONENTES DE TERCEROS, TODAS LAS GARANTÍAS O SERVICIOS PROVISTOS POR WITHSECURE SOLO SE PROPORCIONARÁN PARA LA SOLUCIÓN, Y NO PARA LOS SERVICIOS Y COMPONENTES ADYUVANTES. LAS SOLUCIONES NO ESTÁN GARANTIZADAS POR DICHOS TERCEROS. SIEMPRE QUE LOS DATOS SE TRANSMITAN FUERA DEL SISTEMA DE UN TERCERO A LA SOLUCIÓN, EL TECERO NO SERÁ RESPONSABLE POR LA PRIVACIDAD, SEGURIDAD O INTEGRIDAD DE DICHOS DATOS.

Ninguna información o instrucción oral o escrita provista por WithSecure, sus revendedores, distribuidores, agentes o empleados debe representar una garantía, y usted no debe depender de dicha información o instrucción. Algunas jurisdicciones no permiten las exenciones de este párrafo, de manera que es posible que no se apliquen a usted.

6 Responsabilidad de WithSecure

BAJO NINGUNA CIRCUNSTANCIA Y SUJETO A NINGUNA TEORÍA LEGAL, INCLUIDAS, ENTRE OTRAS, AGRAVIO O CONTRATO, WITHSECURE , SUS EMPLEADOS, LICENCIANTES, REVENDEDORES, DISTRIBUIDORES O PROVEEDORES SERÁN RESPONSABLES HACIA USTED POR NINGÚN DAÑO ESPECIAL, CONSECUENTE, INCIDENTAL O INDIRECTO, INCLUIDOS, ENTRE OTROS, PÉRDIDA DE GANANCIAS O INGRESOS, PÉRDIDA O DAÑOS DE LOS DATOS, ARCHIVOS O DISPOSITIVOS, FALLAS O MAL FUNCIONAMIENTO DE APLICACIONES, INCOMPATIBILIDAD DE REDES O CUALQUIER OTRA PÉRDIDAD COMERCIAL O ECONÓMICA, QUE SURJA DEL USO O LA INCAPACIDAD DE USAR LA SOLUCIÓN, INCLUSO SI WITHSECURE HA SIDO ADVERTIDO SOBRE LA POSIBILIDAD DE DICHOS DAÑOS. LA RESPONSABILIDAD PROMEDIO MÁXIMA DE WITHSECURE, SUS LICENCIANTES, REVENDEDORES Y DISTRIBUIDORES HACIA USTED POR LOS DAÑOS REALES PROVOCADOS POR CUALQUIER CAUSA NO DEBE EXCEDER BAJO NINGUNA CIRCUNSTANCIA LOS MONTOS TOTALES PAGADOS POR USTED POR LA SOLUCIÓN DURANTE UN PERÍODO DE SEIS (6) MESES INMEDIATAMENTE POSTERIOR AL EVENTO QUE PROVOCÓ LA RESPONSABILIDAD.

Algunas jurisdicciones no permiten la limitación o exclusión de responsabilidad por daños incidentales o consecuentes, de manera que es posible que la limitación o exclusión antes mencionada no se aplique a usted o se aplique solo en parte. WithSecure también actúa en nombre de sus empleados, revendedores, distribuidores, licenciantes, proveedores y filiales para eximir, excluir y restringir obligaciones, garantías y responsabilidades, según lo expresado en estos Términos, pero en relación a ninguna otra cosa o fin.

7 Su responsabilidad

Usted es exclusivamente responsable y asume todo el riesgo y la responsabilidad por el uso de la Solución y sus acciones según los resultados provistos por esta.

Sin perjuicio de cualquier estipulación contraria a lo establecido en estos Términos, debe defender, indemnizar y eximir de responsabilidad a WithSecure, sus subsidiarias y empleados de daños, obligaciones, costos y gastos (incluidos las tarifas razonables por abogados) incurridos por WithSecure, sus subsidiarias o sus empleados en relación a reclamos y acciones que surjan o estén relacionados con su uso de la Solución o los servicios que proporciona a terceros mediante el uso de la Solución.

8 Privacidad y recopilación de datos

Recopilación de datos. Usted reconoce que WithSecure necesita recopilar y procesar ciertos datos relacionados con sus dispositivos y redes para que WithSecure le proporcione la Solución. Dado que los datos recopilados y la forma en que se utilizan varían según el tipo y la versión de la Solución, puede encontrar información más detalladas sobre el procesamiento de datos personales en las políticas de privacidad relevantes de WithSecure. Dichas políticas están disponibles a través de la interfaz de usuario de la Solución y en el sitio web de WithSecure. Lo siguiente resume qué tipos de datos suele recopilar la Solución y por qué motivo.

Datos técnicos y de seguridad. Para que WithSecure proteja su dispositivo y red, la mayoría de las Soluciones deben recopilar y procesar datos sobre el dispositivo, la red y el uso de la Solución. Estos datos suelen ser datos de seguridad de objetos, resultados de análisis, estadísticas, metadatos de archivos, métricas de uso de la Solución y otros datos similares. El principio de diseño de WithSecure es limitar la capacidad de WithSecure de vincular estos tipos de datos con usted a nivel personal.

Datos personales. WithSecure también recopila y procesa datos de una manera que sea personalmente identificable para usted, sus empleados, clientes y otros socios. Dichos datos suelen ser i) datos que usted envía en forma activa a WithSecure (por ejemplo, información de contacto y registro, información para resolver un problema de soporte) y ii) datos recopilados automáticamente por la Solución o activados por su uso de una función en particular (por ejemplo, asignación de licencias, información de dispositivos y software, actividad de la cuenta del usuario, ubicación geográfica del dispositivo, sistema operativo, etc.) y iii) conjuntos de datos limitados de los “Datos técnicos y de seguridad” mencionados arriba (por ejemplo, el nombre el malware bloqueado).

Transferencias, divulgaciones y cumplimiento. WithSecure puede utilizar sus filiales o subcontratistas para llevar a cabo cualquiera de las actividades de procesamiento de datos antes mencionadas. WithSecure puede divulgar datos específicos a sus revendedores u otros socios como lo describe la política de privacidad de WithSecure correspondiente. Dichas partes pueden estar ubicadas en el EEE o fuera de él. WithSecure también puede procesar y divulgar datos cuando sea necesario hacerlo por intereses legítimos conforme a las leyes aplicables.

Transparencia. Si la Solución está diseñada para que usted, WithSecure y sus socios la administren en forma conjunta, sujeto a acuerdo, los roles y responsabilidades de los socios involucrados en el procesamiento de los datos personales en esta disposición se establecen en una política de privacidad específica, y usted acepta informar a sus empleados sobre esta.

9 Confidencialidad

“Información confidencial” significa cualquier información confidencial divulgada por WithSecure o usted a otro tercero en relación a la Solución que la parte que divulga caracteriza como confidencial al momento de la divulgación, ya sea en forma escrita u oral, o que, dada la naturaleza de la información o las circunstancias relacionadas con la divulgación, debe considerarse razonablemente como confidencial, excepto la información para la cual la parte receptora pueda demostrar que: (a) es previamente conocida en forma legal por la parte receptora sin restricción de divulgación; (b) es o se convierte, independiente de la acción o falta de acción de la parte receptora, generalmente conocida en la industria relevante o es de dominio público; (c) se divulga a la parte receptora por un tercero y sin restricción de divulgación; (d) es desarrollada en forma independiente por la parte receptora sin acceso a la Información confidencial o (e) debe divulgarse a cualquier autoridad gubernamental o tribunal como resultado de una acción judicial. Si cualquiera de las partes debe divulgar información confidencial de carácter legal, debe notificar a la otra parte sobre la divulgación requerida. Cada parte debe divulgar o usar la Información confidencial solo cuando sea necesario por el motivo por el cual se divulga y conforme a las disposiciones de estos Términos, y debe tomar las medidas razonables para evitar la divulgación o uso no autorizados de la Información confidencial, no menos restrictivas que las medidas adoptadas para proteger su propia información confidencial. En el caso de descubrimiento de divulgación o uso no autorizados de Información confidencial, la parte receptora debe notificar a la parte que divulga de inmediato, y debe realizar todos los esfuerzos necesarios para evitar mayor divulgación no autorizada de dicha información.

10 Cambios

WithSecure mejora sus servicios en forma constante. WithSecure se reserva el derecho de actualizar y realizar cambios en la Solución y modificar las características o funcionalidad de la Solución de vez en cuando. Dichos cambios pueden incluir, entre otros, la adición de nuevas características o la eliminación de las existentes. Cuando dicha actualización o cambio no se implemente automáticamente, sino que se le proporcione como opción voluntaria, deberá usar la versión más reciente de la Solución para optimizar la seguridad y la capacidad de uso. WithSecure también se reserva el derecho de finalizar el mantenimiento y soporte para algunas versiones de la Solución (incluidas las versiones diseñadas para usarse en algunos sistemas operativos) conforme a las políticas de ciclo de vida del producto de WithSecure, lo que puede provocar que la Solución se torne inoperante. No se recomienda el uso de la Solución para la cual se discontinúa el mantenimiento, y dicho uso es de su exclusiva responsabilidad. Puede encontrar las políticas de ciclo de vida del producto y más información sobre ciclos de vida de productos en el sitio web de WithSecure. Ya que es probable que la solución evolucione durante su suscripción, WithSecure puede necesitar revisar estos Términos de vez en cuando. WithSecure publicará los Términos revisados en el sitio web de WithSecure y en cualquier otro punto de interacción donde anteriormente hayan estado disponibles. Una vez publicados, los Términos revisados cubrirán automáticamente a todas las Soluciones e instalaciones de su suscripción (no anulan los términos de las tiendas de aplicaciones). En el caso en el que se produzcan cambios materiales en los Términos, WithSecure también se lo notificará por otros medios y, en este caso, los Términos revisados entrarán en vigencia en un plazo de treinta (30) días a partir de la comunicación. Usted acepta los Términos revisados al seguir usando la Solución. Si alguno de estos Términos se tornara nulo o inaplicable, esto no afectará a la validez del resto de los Términos, que seguirán siendo válidos y aplicables.

11 General

11.1 Adaptación

La Solución está sujeta a limitaciones específicas, como el propósito de uso y ciertos requisitos técnicos, incluidos, entre otros, el sistema operativo, el espacio de almacenamiento, la ubicación geográfica y la conectividad de la red, como lo informan WithSecure o sus revendedores o distribuidores de vez en cuando. Por la presente, usted reconoce y confirma que ha consultado la adaptación de la Solución a sus propios requisitos antes de usarla.

11.2 Licencias de código abierto

Según el alcance por el cual cada componente de la Solución esté disponible para usted bajo una licencia de código abierto, se dispone de una lista de licencias de código abierto aplicables en la interfaz de usuario del producto, y las disposiciones de dicha licencia pueden anular en forma expresa algunos de estos Términos.

11.3 Términos adicionales

La Solución puede contener aplicaciones web o portales web. El uso de dichos sitios puede estar sujeto a términos adicionales. Usted acepta revisar dichos términos de uso adicionales y usar esos sitios únicamente en conformidad con estos. Dichos sitios también pueden pertenecer a un revendedor o distribuidor de WithSecure o a otro tercero. WithSecure no tiene ninguna responsabilidad por sitios de terceros.

11.4 Disponibilidad

Usted queda informado y por la presente acepta que toda la Solución o parte de ella puede quedar momentáneamente no disponible o no operativa por reparaciones, actualizaciones, mantenimiento o por motivos que exceden al control razonable de WithSecure (fuerza mayor). WithSecure, sus licenciantes, revendedores o distribuidores no serán responsables por las consecuencias de dichas interrupciones y tomarán acciones para restaurar la disponibilidad y operación de la Solución lo más razonablemente rápido posible, según las restricciones técnicas detectadas.

11.5 Autorización

Para que la Solución funcione como se espera, usted autoriza a WithSecure, a su nombre, a copiar los archivos sospechosos que contengan código ejecutable desde su dispositivo o desde cuentas de servicio de terceros vinculadas a la Solución a los sistemas de backend de WithSecure, de manera que WithSecure los pueda analizar en forma más efectiva en busca de actividad maliciosa.

11.6 Finalización

Sin perjuicio sobre cualquier otro derecho de finalización o caducidad en estos Términos o bajo contrato o ley, WithSecure puede finalizar su licencia de la Solución de manera inmediata sin previo aviso si usted infringe cualquiera de estos Términos o usa las funciones de la Solución para fines distintos a los indicados en la documentación oficial. Cuando WithSecure observe que usted está usando la Solución i) infringiendo estos Términos, ii) otros términos aplicables o iii) de manera distinta a su objetivo iv) en una manera que ponga en riesgo su uso por parte de terceros (por ejemplo, monopolizando el ancho de banda de acceso) o para provocar daños a terceros; WithSecure se reserva el derecho (i) de no renovar su licencia, (ii) de limitar su uso de la Solución o parte de ella o (iii) de finalizar la licencia. En el caso de que el acuerdo entre WithSecure y el revendedor o distribuidor de WithSecure que le proporciona la Solución finalice, WithSecure o su revendedor o distribuidor le notificará sobre la finalización prematura de su licencia. Usted no tendrá derecho a reembolsos, daños u otra compensación de WithSecure como resultado de dicha finalización. Todas las restricciones de uso permanecen después de la finalización.

En el caso de la finalización de su licencia/suscripción, e independientemente del motivo de esta, usted deberá de inmediato i) discontinuar el uso de la Solución y ii) eliminar todas las copias de la Solución que puedan estar instaladas en su entorno de TI.

11.7 Restricciones de exportación

Usted reconoce y acepta que la Solución puede estar sujeta a restricciones y controles impuestos por las leyes y reglamentaciones aplicacables, incluidos, entre otros, las reglamentaciones de exportación de la Unión Europea y de los Estados Unidos (en conjunto, “Reglas de exportación”). Usted acepta y certifica que ni la Solución ni ningún producto directo se comprará, enviará, transferirá o volverá a exportar, en forma directa o indirecta, a ningún país para el cual dicha exportación esté prohibida bajo las Reglas de exportación y las reglamentaciones aquí descritas, ni que se utilizará para ningún motivo prohibido por estas. Al usar la Solución, usted reconoce y acepta lo antes mencionado, y confirma y garantiza que cumplirá con las Reglas de exportación cuando exporte o vuelva a exportar o importe la Solución o cualquier tecnología de información subyacente.

11.8 Ley vigente y resolución de disputas

A menos que se exprese lo contrario, estos Términos son vigentes conforme a las leyes de Finlandia. Con la única excepción de la aplicación de desagravio por mandato, cualquier disputa, controversia o reclamo que surja de estos Términos o esté relacionado con ellos, o la brecha, finalización o validez de estos que no pueda resolverse en forma amigable o mediante mediación, deberá establecerse finalmente por medio de arbitraje conforme a las Reglas de arbitraje de la Cámara de Comercio de Finlandia. La cantidad de árbitros será uno. El lugar del arbitraje será Helsinki, Finlandia. El idioma del arbitraje será el inglés.

En el caso de que las licencias se compren dentro o a nombre de licenciatarios que residen en los Estados Unidos u operan bajo las leyes de los Estados Unidos, la ley vigente de estos Términos será la ley del Estado de Nueva York. En dicho caso, con la única excepción de la aplicación de desagravio por mandato, cualquier disputa, controversia o reclamo que surja de estos Términos o esté relacionado con ellos, que no pueda resolverse en forma amigable o mediante mediación, deberá establecerse finalmente por medio de un árbitro conforme a las Reglas de JAMS. El lugar del arbitraje será Nueva York, EE. UU.

WithSecure provides these Community forums as a service to its users and customers, to help them exchange ideas, tips, information, and techniques related to overall security related issues and to our services. These forums are here for the enjoyment and benefit of all members and accessible to all who register. Like any community, they are most valuable when everyone obeys certain basic guidelines and rules for online behavior.

Posting and prohibited content

Use of the Community is at your own risk. Do not post any information, especially personal information such as addresses and phone numbers, that you do not wish to make public. Any information that you post to public boards can be obtained and used by others. You are responsible for any personal information you disclose to the Community. WithSecure or Lithium Technologies Inc. ("Platform Provider") is not responsible for third parties' use of information posted to the open community.

Users of the Community agree not to upload, post, or otherwise transmit any content that includes any of the following inappropriate content:

  • Content that is: unlawful, libelous, harmful, vulgar, obscene, derogatory, pornographic, abusive, harassing, threatening, hateful, objectionable with respect to race, religion, creed, national origin or gender;
  • Any private or personal information or content that is not your own or that you do not have rights to transmit, such as:

  • Content or behavior that interferes with the operation of the site or with another member's ability to use the site;
  • Evading site controls such as bans, or otherwise disregarding the directions of the site moderators or administrators
  • Content that infringes copyrights or other intellectual property rights of third parties.

 

Enforcement

WithSecure may remove any information, in its sole discretion, including but not limited to personal data or data, material or content provided by any of the users, considered to violate the Terms or be inappropriate for the Community for any reason. WithSecure shall under this agreement have no obligation to monitor any of the material provided by you to WithSecure and/or to the Community, but may do so at its discretion. WithSecure also retains the right to immediately revoke any and all of Your access rights in case Your breach of any of these Terms or suspected misuse of the Community.

Feedback and ideas

Any bulletin messages, suggestions, ideas, bulletin board postings or concepts ("material") that are submitted to WithSecure via Community website shall become, and remain the property of WithSecure. Furthermore, WithSecure is not responsible for the confidentiality of any material communicated to Community. By communicating material to the Community, you agree that WithSecure has the right to use and publish the material in products or publications for any purpose, including, but not limited to, product and/or service development, advertising and promotional purposes. You agree not to take action against us in relation to material that you submit.

Privacy

User data

We collect your personal data only when registering to the community service. The data includes typically your name and email address. You can enter more information to the system but this is not mandatory.  Registration is required when you wish to post to the community and is used for operating the community, in particular maintaining the messaging structure. 

Legal grounds

We process your data so that we can provide you with the community services and continuously improve on the content and usability of the service. Our legal ground for this is “contract performance” so we can manage the community.

It is necessary for us to have the data requested for us to be able to create your individual account to WithSecure Community. The identification of data is needed to highlight active contributors to WithSecure community.

Recipients

The data is not disclosed to external entities beyond the 3rd party platform provider and WithSecure Polish and Malaysian subsidiaries, which both process data only on WithSecure Corporation’s instructions.

Retention

We store your community account data based on your consent for 12 months since you last logged in to the system after which your community account is deleted. Users with a valid WithSecure service subscription are excluded from the deletion. During this time, you have full control on your own community data we have on you. You can edit and delete your community data via accessing your WithSecure Community account.

Analytics

We want to make this service even better. To do that, we need to know - for example - which articles/posts are viewed the most and found most useful and how users find the service. 

When visiting our community, we collect session data about your activities in non-personally identifiable format to further develop the community and its usage. The use of website analytics is explained in the website privacy policy.

Correctness of information and disclaimer of warranty

The Community and its contents, regardless of who originates that content, are provided "as is", without warranty of any kind. WithSecure, on behalf of itself, its employees, officers and suppliers, Platform Provider and those that have contributed to data presented in the Community expressly disclaim all implied warranties of any kind. Users of the Community agree that WithSecure is not responsible for the accuracy of the content of the Community and will not be liable for any damages incurred as a result of their use of any such content.

Where the Community contains links to third party sites, you acknowledge that the content on such third party sites may be subject to change from time to time and that such third party sites are not under WithSecure's control and that WithSecure has no liability in regards to the contents of such third party sites or Your activities in such third party sites.

Indemnity and limitation of liability

CONTENT POSTED TO THE COMMUNITY IS MOSTLY PROVIDED BY THIRD PARTIES NOT AFFILIATED WITH WITHSECURE OR PLATFORM PROVIDER. YOU AGREE THAT WITHSECURE OR PLATFORM PROVIDER DOES NOT CONTROL, AND IS NOT RESPONSIBLE IN ANY WAY, FOR THIS THIRD-PARTY CONTENT. YOU SHALL BE SOLELY RESPONSIBLE FOR YOUR CONDUCT AND USE OF THE COMMUNITY AND YOU AGREE TO INDEMNIFY AND HOLD WITHSECURE AND PLATFORM PROVIDER HARMLESS FROM ANY CLAIM MADE BY ANY THIRD PARTY RELATING TO OR ARISING OUT OF CONTENT SUBMITTED, POSTED, TRANSMITTED, OR MADE AVAILABLE THROUGH COMMUNITY, USE OF COMMUNITY, VIOLATION OF THE TERMS OR VIOLATION OF ANY RIGHTS OF ANOTHER. UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY, CONTRACT, OR OTHERWISE, SHALL WITHSECURE OR PLATFORM PROVIDER BE LIABLE TO YOU OR TO ANY THIRD PARTY FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND.

Changes to terms

We will be making changes to Community, these Terms and relevant policies (including those referred herein) from time to time. We notify about such changes when we deem that changes in terms are material enough to warrant a notification / re-approval, but will not be required to do so in case of minor changes. Changed Terms shall be available in the same location and shall be effective when posted. In case you choose not to accept the then current Terms, you should cease Your use of the Community. The Terms and policies in force at the time you used the Community shall be applicable to Your use of Community made under such Terms. The month of the copyright notice at the end of Terms will allow you to easily monitor when changes in terms have occurred.

General

WithSecure may discontinue, modify or terminate any of user accounts to Community at its sole discretion. Upon termination of Community or Your usage rights therein, any terms that would reasonably survive termination, shall continue to be in force including, but not limited to; terms concerning restrictions on use, disclaimer of warranty, limitation of liability.

The Terms are not necessarily exhaustive and additional terms relating to certain contents or functionalities available in the Community may exist.

If any of these conditions is deemed invalid, void, or for any reason unenforceable, such portion of the condition will be deemed severable and will not affect the validity and enforceability of any remaining condition or these Terms.

These Terms shall be governed under the laws of Finland without regard to conflict of laws rules and principles.

 

Remote support

Remote Support

By utilizing WithSecure™ Corporation remote support services, you (on behalf of yourself and / or the legal entity you represent) agree:

  • to grant remote access to your computer to WithSecure's or its affiliates' or subcontractors' support personnel for the purposes of providing remote technical support and that you are authorized to grant access to computer or other device you are establishing the remote connection.
  • that you are personally responsible for ensuring a valid backup of any data and applications has been made prior to any activities undertaken via the WithSecure remote support tool.
  • that due to nature of certain technical problems, it may not be possible to resolve your particular problem via remote support.
  • that because of complexity and variety of support cases and inevitable dependencies and reliance on third party technologies; all support is provided on "best efforts" basis and WithSecure may not be able to remedy some issues.
  • that you do not have privacy, security or password sensitive applications / web pages / email open during remote support activities.
  • that for reasons of providing good customer care we may help you with and offer solutions to i) certain product features that are undesirable to you and/or ii) issues arisen due to third party product, as part of our support services but provision of any help for solving and/or circumventing the abovementioned items is not deemed as acknowledgement that any such issues would constitute errors in our software or services.
  • if you are granted access to a copy of WithSecure software for support resolution purposes; i) in the absence of specific license terms in the said software; all use of such software copies are subject to WithSecure end user license terms in the WithSecure commercial software you have installed on your device, or ii) in the absence of such installation; the end user license terms. You agree that except for the time-limited use of software for the purpose of solving your support problem, no other rights to software are granted to you.
  • that for the purposes of providing you with support and problem resolution services, i) you may be asked to provide personally identifiable data (including emails and/or metadata thereof) to WithSecure or its affiliates or its support partners and/or ii) where necessary to resolve the support issue, data from your device that is identifiable to you may be collected and sent to WithSecure, to its affiliates and/or to its support partners for problem resolution analysis. All such data will be processed in accordance to WithSecure privacy policy.
  • that all remote services and software are provided as-is and at your own risk. You acknowledge and understand that the support engineer providing you with support services is not familiar with interconnections, settings, or special applications on your device or all purposes to which your device is used for or for which the device is connected to.
  • that any suggestion given by WithSecure, its affiliates or its support partner to resolve the issue is only indented for the support problem at hand and is not intended or offered as a generic advice for other purposes.
  • not to hold WithSecure responsible or liable for any damages, compensations, fees or costs whether direct or indirect, consequential, incidental or otherwise and whether based on contract, tort or equity which may occur (e.g. for reasons of system reboot, data loss or corruption, system failure, unauthorized access or otherwise) and that — in the absence of wilful misconduct on its part — WithSecure (on behalf of itself, its affiliates, its subcontractors and their officers and employees) disclaim any liability for any damages incurred in connection with the usage of this service to the fullest extent allowed by law. For the avoidance of doubt; WithSecure or its affiliates are not liable for any negligent or wilful actions of its subcontractors undertaking the said support activities.
  • that unless otherwise stated below, these terms shall be governed under the laws of Finland without regard to conflict of laws rules. The courts of Finland shall have the exclusive jurisdiction and venue to adjudicate any dispute arising out of these terms. In the case of licenses purchased within or on behalf of licensees residing within the United States or operating under the laws of the United States the governing law of these terms shall be the laws of the State of California without regard to conflict of laws rules and principles and without regard to the United Nations Convention of Contracts for the International Sale of Goods. In such cases, the exclusive jurisdiction and venue to adjudicate any dispute arising out of these terms shall be of the federal and state courts located in California. In respect of licenses purchased by consumers residing outside Finland or the United States, these terms may be governed by the mandatory local laws of such jurisdictions.
